Terms and Conditions of So Stay Bed & Breakfast

§ 1 General Provisions

  1. These Terms and Conditions define the rules for reservations and the provision of short-term rental services at So Stay Bed & Breakfast.
  2. These Terms and Conditions constitute an integral part of the short-term rental agreement concluded via the website, electronically, or through booking portals (e.g., Booking.com).
  3. So Stay Bed & Breakfast is a fully self-service facility. The check-in process, payments, and issuance of room cards are conducted via the multimedia kiosk located on the premises.

§ 2 Definitions

  1. Service Provider – Maciej Wąsik, conducting business as Play Media Maciej Wąsik, address: Stogi 20a, 82-200 Malbork, NIP: 5792033689, contact: info@sostay.pl, tel. +48 690 577 555.
  2. FacilitySo Stay Bed & Breakfast guest rooms.
  3. Client/Guest – a person of legal age using the services of the Facility.

§ 3 Reservations and Fees

  1. Reservations can be made electronically, by telephone, or through external portals.
  2. Upon making a reservation, the Guest is obliged to pay a deposit in the amount and within the period specified in the reservation confirmation.
  3. The remaining fee for the stay (minus the deposit paid) is collected on the day of arrival via the self-service kiosk or in the form of an online prepayment.
  4. The Guest may cancel the reservation free of charge up to 5 days before the start of the stay. In case of cancellation after this deadline, the deposit is non-refundable.
  5. In the case of "Last Minute" reservations (made on the day of arrival or the day before), the Facility does not guarantee the possibility of modifying the default bed configuration in the room.
  6. The Guest is obliged to pay the local city tax in accordance with the current rates applicable in the municipality.

§ 4 Stay Rules and Self-Service

  1. The stay period (hotel day) lasts from 3:00 PM to 11:00 AM the following day.
  2. Check-in is performed independently using the self-service kiosk, which issues the room access card after all formalities are completed.
  3. The Guest is obliged to return the room card by placing it in the designated slot in the self-service kiosk no later than 11:00 AM on the day of departure.
  4. A fee of 50 PLN will be charged for the loss of a card or failure to return it to the kiosk on the day of checkout.
  5. Unregistered persons may stay in the room from 7:00 AM to 10:00 PM. The presence of third parties after 10:00 PM results in a fee for each additional person according to the extra bed price list.
  6. Remaining in the room after 11:00 AM without prior arrangement with the staff (via phone/email) will result in a fee for half a day’s stay.

§ 5 Safety and Liability

  1. A strict no-smoking policy applies to the entire Facility, including tobacco, tobacco products, and e-cigarettes. Violation of this ban results in a fine of 500 PLN.
  2. The Guest will be charged a financial penalty of 1000 PLN for any unjustified activation of the fire alarm (e.g., by smoking in the room, using an open flame, or unjustified use of manual call points/ROP).
  3. The Guest bears full financial liability for any damage or destruction of the Facility's equipment caused by their fault, the fault of their visitors, or animals under their care.
  4. For fire safety reasons, it is prohibited to use private heating devices (e.g., heaters, hot plates, irons) in the rooms that are not part of the room equipment.
  5. The Facility is not responsible for the loss or damage of a vehicle belonging to the Guest or items left in the room. Due to the lack of a physical reception desk, the Facility does not provide a deposit service for valuables.

§ 6 Protection of Minors

  1. The Facility implements Standards for the Protection of Minors in accordance with the provisions of the Act on Counteracting Threats of Sexual Crimes.
  2. During the check-in process at the kiosk or during verification by staff, the Guest may be asked to confirm the child's identity and the relationship between the guardian and the child. Full details of the Standards for the Protection of Minors are available on the website and at the self-service kiosk.

§ 7 Personal Data Protection (GDPR)

  1. The administrator of Guests' personal data is Play Media Maciej Wąsik.
  2. Data is processed for the purpose of executing the rental agreement, fulfilling legal obligations, and pursuing potential claims.

§ 8 Complaints and Final Provisions

  1. Any defects or complaints should be reported immediately by calling +48 690 577 555 or by e-mail at info@sostay.pl.
  2. Pursuant to Art. 38 point 12 of the Act on Consumer Rights, the Guest is not entitled to withdraw from a distance accommodation agreement.
  3. In matters not regulated by these Terms and Conditions, the provisions of the Civil Code and other generally applicable provisions of Polish law shall apply.
